Key Functions & Responsibilities
Staff Discipline, Governance & Auditing Section
01
Oversee and manage all matters relating to staff disciplinary proceedings and conduct across the University.
02
Advise Responsibility Centres (PTJs) on staff disciplinary issues and recommend appropriate courses of action for received complaints.
03
Receive and evaluate investigation reports from PTJs, Security Department, Sexual Harassment Core Committee, and other designated panel committees.
04
Execute administrative actions for misconduct and initiate formal disciplinary proceedings for severe policy violations.
05
Provide strategic advisory to University Management regarding proposed actions on staff disciplinary cases.
06
Ensure all staff disciplinary procedures strictly adhere to the Statutory Bodies (Discipline and Surcharge) Act 2000 (Act 605) to safeguard University interests.
07
Conduct briefings and awareness sessions for Responsibility Centres regarding staff disciplinary protocols and procedures.

Serve as the Secretariat and manage disciplinary cases for the University Staff Disciplinary Committee.

Monitor and track all staff disciplinary cases until final resolution and decision enforcement.

Administer and coordinate the University staff asset and property declaration processes.

Advise University Management on corporate governance enhancements and internal organizational frameworks.

Promote awareness on AUKU 1971, Act 605, USM Constitution, USM Student Disciplinary Rules, and financial regulations among staff and students.

Advise the Internal Audit Unit and University Audit Committee regarding auditable activities, information, and statutory compliance matters.

Procurement Contract Management & Intellectual Property Section
01
Manage financial contract matters, including the drafting and execution of University procurement contracts, administration of Performance Bonds, handling vendor appeals on supply issues, and monitoring executed contract performance.

Serve as the Secretariat for vendor appeal cases concerning extension of delivery periods and applications for penalty/late delivery fee waivers in cases of delayed supply delivery.
03
Draft, review, and negotiate commercialisation agreements involving start-up and spin-off companies under the Centre for Innovation & Consultation (CIC), while providing legal advisory on intellectual property matters.

Key Functions & Responsibilities
MoU/MoA Drafting & Management Section
01
Draft, review, revise, and amend Memoranda of Understanding (MoU), Memoranda of Agreement (MoA), and Letters of Intent (LoI) for academic, corporate, and commercial collaborations signed by the University.
02
Negotiate terms and conditions of MoUs and MoAs with the Malaysian Government, domestic and international universities, and private sector entities to protect University interests.
03
Consult with the Ministry of Higher Education and Attorney General's Chambers regarding amendments and drafting of higher education Acts (such as AUKU), Statutes, Rules, and MoU/MoA guidelines.
04
Review, analyze, and vet external MoUs and MoAs to ensure the University's strategic interests and rights are fully preserved in every collaboration.
05
Manage the end-to-end execution process, including document printing, signature acquisition, stamp duty execution (stamping), and systematic record-keeping of MoUs/MoAs.
06
Manage and curate MoU/MoA data for official reporting to Responsibility Centres (PTJs), the University Board of Governors (LGU), and the Ministry of Higher Education.
07
Prepare and supply verified MoU/MoA data for the Malaysian Research Assessment (MyRA) audit exercises.

Formulate and draft specific institutional policies and regulatory frameworks for the University.

Litigation & Legal Services Section
1. Legal Advisory Services
01
Provide legal advice and opinions to the University and relevant stakeholders in accordance with statutory laws, University policies, and public interest.
02
Review and advise the University and Responsibility Centres (PTJs) regarding breach of contract cases and recovery strategies.
03
Ensure all legal advice provided aligns strictly with the Federal Constitution of Malaysia, existing statutory legislation, and prevailing University regulations.
2. Litigation & Legal Proceedings

Represent the University in all legal proceedings brought by or instituted against the University across all court jurisdictions.
05
Draft, review, vetting, and approve court pleadings prepared by external legal panels, including affidavits, notices of application, and writs of summons.
06
Manage, supervise, and track active litigation cases involving the University until full and final case resolution.
07
Monitor external panel lawyers, attend court hearings, and conduct case management discussions regarding ongoing University litigation matters.
08
Conduct out-of-court settlement negotiations with opposing parties, external agencies, and legal counsels.
09
Manage litigation for breach of study leave agreements under the Academic Staff Training Scheme (RLKA), Academic Staff Higher Education Scheme (RPTKA), Paramedics, and related schemes.

Manage recovery suits for salary overpayments, outstanding debts, issue Letters of Demand (LOD), and compile legal litigation data for University Management.
3. Drafting & Rental/Lease Management

Draft, review, and finalize tenancy and rental agreements to ensure full compliance with statutory provisions and University policies.

Advise on legal obligations and contractual implications arising from tenancy agreements for both the University and third-party tenants.
13
Monitor University tenancy portfolios across all campuses, including commercial premises managed by University subsidiaries, and initiate legal recovery for rental arrears.

Health Campus & Medical Negligence Section

Act as the University liaison in cases involving Medical Negligence / Potential Medical Negligence and insurance claims related to Hospital USM (HUSM).

Manage, monitor, and coordinate legal notifications, documentation, and liaison with panel lawyers, medical specialists, hospital departments, and relevant parties for medical negligence claims.

Represent the University in dealings with judicial courts and enforcement authorities regarding court proceedings involving USM Health Campus staff or students.

Provide legal advisory, guidance, and assist in drafting and vetting MoU, MoA, and Non-Disclosure Agreements (NDA) for the Health Campus.

Provide legal opinions, guidance, and recommend internal resolution mechanisms for legal issues involving patients, medical staff, students, or external parties.

Manage, investigate, and handle misconduct complaints involving staff and students at the USM Health Campus.

Review, advise, draft, and refine guidelines, institutional policies, SOPs, flowcharts, undertakings, and tender specifications for Hospital USM and Health Campus Responsibility Centres (PTJs).

Receive investigation reports concerning student disciplinary actions from the Security Department, Examination Cheating Committee, Plagiarism Investigation Committee, and other Investigation Committees appointed by the Vice-Chancellor.

Ensure all student disciplinary procedures strictly comply with the Universities and University Colleges Act 1971 (AUKU) and the Universiti Sains Malaysia (Student Discipline) Rules to safeguard University interests against legal challenges.

Share knowledge and promote awareness among students regarding AUKU, the University Constitution, USM (Student Discipline) Rules, and related regulations to ensure compliance.
06
Provide briefings to Responsibility Centres on student disciplinary procedures, handling of evidence, and related administrative matters, including examination cheating management.
